This data processing addendum (“Addendum”) is located between Red Hat Inc. (“Red Hat”) and the customer (defined below) and applies when Red Hat processes personal data disclosed to it by the customer as part of your content as part of the Red Hat online service agreement (the “agreement”). This addendum takes effect from the effective date of the agreement. This addition applies only if and only to the extent that Red Hat is a personal data processor in the provision of products or services under the agreement. This amendment aims to demonstrate that the parties comply with EEA data protection legislation and all other data protection laws identified by www.redhat.com/en/about/agreements/dpl (all “data protection laws”). 14. Export control. Red Hat may provide you with software, services and/or technical data that are subject to export control restrictions under U.S. or other countries( export control laws). You agree to comply with all applicable export control laws related to your use of services, content and users, and agree not to use the services or software if you or your users are not allowed to receive under export control legislation (for example. B, if you are in a jurisdiction subject to U.S. sanctions that currently include Cuba, Iran, North Korea, Sudan and Syria and are subject to changes, as revealed by the U.S. government).
Red Hat is not responsible for your compliance with the Export Control Act. If (a) you violate this section, the export control provisions of a software license agreement or a provision relating to these sections, or (b) if you violate one of Red Hat`s export control laws to grant you access to one of the services, Red Hat may terminate the agreement immediately without being held responsible. You agree not to use services related to nuclear, chemical or biological weapons or missile technology, unless this has been approved by the relevant government authority through a specific regulation or license. 3.4 Your license to Red Hat. You grant Red Hat and all third parties whose services may depend on red Hat to provide the Services with a permanent, global, non-exclusive, non-negotiable, free license for the manufacture, use, reproduction, preparation of derivatives, distribution, sale, sale, offer of sale, importation, execution and display of content for the purpose of providing the Services. Red Hat does not expect to access your content or make it available to third parties, unless:a) support or enhancement of the services available to you, (b) to investigate any violations of your agreements with Red Hat or to establish Red Hat`s legal rights or to defend rights, (c) to detect, prevent or correct fraud, technologies or security issues, (d) protect against damage to the rights, property or security of Red Hat, its users or the public, or (e) in accordance with the law or law (e.g..B. Red Hat may collect anonymous data about your use of the services and use them for any purpose. Except as stated in this section, Red Hat does not obtain any rights to the content under this agreement. 7.2. Business partners. Red Hat has agreements with certain authorized third parties (“business partners”) to promote, market and support services. When you purchase services through a business partner, Red Hat confirms that it is responsible for providing the software and services under the terms of this Agreement.
Red Hat is not responsible (a) for the actions of trading partners, (b) for additional commitments that trading partners have to you, or (c) products or services that trading partners provide to you under separate agreements between you and the counterparty. You recognize and accept that business partners and Red Hat can share information about you, your users or the use of the Services.
